Welcome to Simple PostgreSQL. These Terms of Service ("Terms") govern your use of the Simple PostgreSQL desktop application and related services. By using Simple PostgreSQL, you agree to these Terms.

1. Acceptance of Terms

By creating an account, downloading, installing, or using Simple PostgreSQL, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use Simple PostgreSQL.

2. Description of Service

Simple PostgreSQL is a desktop application that provides tools for managing PostgreSQL databases. The service includes:

  • Database connection management
  • Query execution and visualization
  • Schema exploration and management
  • Data export capabilities
  • Other features as described on our website

3. Account Registration and Security

3.1 Account Creation

To use Simple PostgreSQL, you must:

  • Be at least 16 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

3.2 Machine Association

Your license is associated with a specific device. Transferring your license to a new device requires contacting support or using the machine transfer feature in the application.

3.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4. License and Subscription

4.1 License Grant

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use Simple PostgreSQL on one device.

4.2 Free Trial

New users receive a 14-day free trial. No payment information is required during the trial. After the trial expires, you must purchase a license to continue using Simple PostgreSQL.

4.3 Paid Subscription

Paid subscriptions are billed annually. Fees are non-refundable except as required by law or as stated in our refund policy. We reserve the right to change pricing with 30 days' notice.

4.4 Subscription Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings or by contacting support.

5. Acceptable Use

5.1 Permitted Use

You may use Simple PostgreSQL for lawful purposes only, including:

  • Managing your own databases
  • Databases you have permission to access
  • Development, testing, and production environments

5.2 Prohibited Use

You may not:

  • Reverse engineer, decompile, or disassemble the software
  • Remove or modify any proprietary notices
  • Share your license with others or install on multiple devices
  • Use the software to access databases without authorization
  • Violate any applicable laws or regulations
  • Interfere with or disrupt the service or servers
  • Use the software for competitive analysis or to build a competing product
  • Attempt to gain unauthorized access to any systems or networks

6. Intellectual Property

6.1 Our Rights

Simple PostgreSQL and all related content, features, and functionality are owned by Petizoutils and are protected by copyright, trademark, and other intellectual property laws.

6.2 Your Data

You retain all rights to your database content and queries. We do not claim ownership of any data you access, create, or manage through Simple PostgreSQL.

6.3 Feedback

If you provide feedback, suggestions, or ideas about Simple PostgreSQL, we may use them without any obligation to you.

7. Privacy and Data Protection

Your use of Simple PostgreSQL is also governed by our Privacy Policy. We do not access, store, or transmit your database credentials or the data in your databases. All database connections are made directly from your device.

8. Updates and Modifications

We may update Simple PostgreSQL from time to time to add features, fix bugs, or improve performance. Some updates may be required for continued use. We may also modify these Terms at any time. We will notify you of material changes via email or in-app notification.

9. Termination

9.1 By You

You may terminate your account at any time by contacting support. Upon termination, your license will be revoked and you must cease using Simple PostgreSQL.

9.2 By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • Your payment fails or subscription expires
  • We are required to do so by law
  • We discontinue the service (with 30 days' notice)

9.3 Effect of Termination

Upon termination, you must stop using Simple PostgreSQL and uninstall the software. Provisions that should survive termination (including intellectual property rights, disclaimers, and limitations of liability) will continue to apply.

10. Disclaimers

SIMPLE POSTGRESQL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • Simple PostgreSQL will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The software is free of viruses or harmful components
  • Results obtained from using Simple PostgreSQL will be accurate or reliable

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF SIMPLE POSTGRESQL.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF SIMPLE POSTGRESQL SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of Simple PostgreSQL
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles.

13.3 Informal Resolution

Before filing a claim, you agree to contact us at simplepostgresql@petizoutils.com to attempt to resolve the dispute informally.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding Simple PostgreSQL.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

14.3 Waiver

Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision.

14.4 Assignment

You may not assign or transfer these Terms or your license without our written consent. We may assign these Terms without restriction.
